FAQ
Is it compulsory for businesses in Spain to install EV charging points?
Yes, in many cases. Existing non-residential buildings with more than 20 parking spaces had to have one charging station for every 40 spaces from 1 January 2023. New office, retail, hotel or industrial buildings with more than 10 spaces must also have cable ducting in 20 % of the spaces.
Are EV chargers mandatory for businesses? The cases
Whether a business must install charging points depends on whether the building is existing or new and how many parking spaces it has. The obligations come from Royal Decree-law 29/2021, Climate Change Law 7/2021 and section HE 6 of the Spanish Building Code (Código Técnico de la Edificación).
| Case | Requirement |
|---|---|
| Existing non-residential building with more than 20 spaces | One station for every 40 spaces or part thereof, before 1 January 2023 |
| New non-residential building with more than 10 spaces (licence from 16 December 2022) | Ducting in 20 % of the spaces and one station for every 40 |
| New car park not attached to a building | At least one station for every 40 spaces |
| Spanish central government building | One station for every 20 spaces |
Who it affects in practice
Offices, shopping centres, hotels, car dealerships, warehouses with parking for staff or customers, and car parks. In Seville, Spain, typical cases are units on industrial estates such as PISA, La Isla, Calonge or the PCT Cartuja technology park, and hotels and shops with their own parking.
What happens if you do not comply
Technical sources point out that there is no specific penalty regime for the 2023 obligation, but there is liability in an inspection and in activity licences. And more and more customers, guests and employees arrive by electric car.
How it is usually solved
- 7.4 to 22 kW AC chargers, with Type 2 sockets.
- User management with RFID cards or an app, and the OCPP protocol to monitor consumption and, if you wish, charge for it.
- Dynamic power sharing to avoid having to increase the supply.
- A technical project when total charging power exceeds 50 kW, with an initial inspection by an authorised inspection body (OCA).
- Rooftop solar to charge during working hours with your own energy.
