Article 17.5 of the LPH (EV charger in a communal garage)

Provision of the Spanish Horizontal Property Law that lets you install an EV charger in your own parking space simply by notifying the comunidad (owners' association) beforehand, with no vote. The installation and electricity costs are yours.

What article 17.5 says

Article 17.5 of the Horizontal Property Law (Ley de Propiedad Horizontal, LPH) states that installing a charging point for private use in the building’s car park, provided it is in an individual space, only requires prior notice to the comunidad. The person concerned pays all the installation and electricity costs. No permission, vote or meeting is needed.

The Supreme Court ruling of 1 December 2025

The Supreme Court, in judgment 1745/2025 of 1 December 2025 (announced in a press release on 12 December), ruled that prior notice is enough even if the cable runs fully or partly through communal areas or must be fixed to them. The comunidad could only object if there were an unnecessary or disproportionate impact on those elements or harm to other owners.

How to give notice

In writing to the president or property administrator, with proof of delivery (burofax, recorded letter or email with receipt). State the space, the ITC-BT-52 scheme chosen, the cable route, the charger, the registered installation company and your commitment to pay costs and consumption. The law sets no waiting period; giving 30 days is recommended practice so the comunidad can arrange access to the meter room.

What the comunidad can and cannot ask

  • It can ask for a registered company, respect for conduits and fire compartments, and repair of affected elements.
  • It cannot impose a brand or installer, or charge you a fee.
  • Not allowed: connecting the charger to the communal services meter, since the consumption is yours.
  • Rented space: you need the space owner’s consent.

A shared installation for the whole garage falls under article 17.1 instead, requiring a vote of one third of owners. See EV charger in a communal garage in Seville, Spain.
